The Concierge uses artificial intelligence. Requests may be processed by third-party AI providers, including providers such as OpenAI. Information you enter into the Concierge may therefore be transmitted to service providers acting on Sundance’s behalf. The Concierge provides general informational assistance and lead routing. It is not a substitute for legal, accounting, lending, insurance, valuation, or other professional advice.

Transaction information is used to perform the engagement, coordinate with necessary participants (see Section 5.B), meet legal and recordkeeping duties, and prevent fraud. Visiting the public website or using the Concierge for general questions does not, by itself, open a transaction file.

3. HOW WE MAY USE INFORMATION

We may use information for purposes that may include: answering inquiries; providing brokerage services; providing property-management services; rental analyses; assisting buyers, sellers, owners, investors, or renters; scheduling; follow-up communications; operating the AI Concierge; routing inquiries; customer service; recordkeeping; security and fraud prevention; troubleshooting; website improvement; measuring service performance; legal and regulatory compliance; enforcing agreements; establishing, exercising, or defending legal claims; business administration; maintaining required brokerage records; permitted marketing; and other purposes disclosed at collection or for which we obtain consent. We may also use aggregated or de-identified information.

4. ARTIFICIAL INTELLIGENCE AND AUTOMATED SYSTEMS

Sundance may use artificial intelligence and automated systems for purposes that may include: answering general questions; inquiry routing; intent identification; preliminary responses; organizing lead information; assisting staff or agents; website operations; security; and customer service.

AI-generated information can contain errors and is not a representation, guarantee, valuation, legal conclusion, contractual commitment, or professional opinion. Material decisions should be confirmed with an appropriate licensed professional.

Important current fact: Sundance does not currently enable its planned Conversation Intelligence system for systematic transcript analytics or AI-training purposes. If materially different transcript analytics, profiling, or training uses are added later, Sundance may update this Policy and provide additional notice or consent where required.

5. HOW WE MAY DISCLOSE INFORMATION

A. Service Providers

We may disclose information to service providers that help us operate, which may include providers for hosting, cloud infrastructure, databases, AI processing, email delivery, cybersecurity, spam prevention, website maintenance, communications, storage, CRM, property-management software, and technical support. Depending on the feature in use, providers may include services such as OpenAI (AI prompt processing), Neon (leads database storage), Resend (email notifications), Render (AI Concierge hosting), WP Engine (website hosting), Google reCAPTCHA, and other vendors used from time to time.

B. Real-Estate and Transaction Participants

Where reasonably necessary for a real-estate or property-management matter, we may disclose information to Sundance professionals; cooperating brokers; property managers; owners; tenants; buyers or sellers; title companies; lenders; inspectors; contractors; attorneys; accountants; insurance professionals; and other transaction participants. Simply visiting the website does not itself cause disclosure to these parties.

C. Legal and Safety Purposes

We may disclose information as required or permitted by law, including to respond to a subpoena, court order, or government request; protect legal rights; detect or prevent fraud or security incidents; protect safety or property; enforce contracts; or establish, exercise, or defend legal claims.

D. Business Transactions

We may transfer information in connection with a merger, acquisition, reorganization, financing, sale of assets, or similar transaction, subject to applicable law.

E. Affiliates, Related Entities, and Partner Boundaries

Sundance Realty & Associates LLC may from time to time be affiliated with, commonly owned with, or operationally related to other businesses controlled by the same principal(s). Related entities may include businesses involved in brokerage, property management, design, construction, investments, or other ventures as disclosed in a particular engagement.

Common ownership or an operational relationship does not, by itself, authorize sharing your personal information. Any sharing with a related entity or business partner must have a specified purpose consistent with this Policy and any applicable collection notice. Depending on the recipient’s role, that purpose may include providing a service you request, evaluating a potential engagement, supporting shared systems, or meeting legal obligations. Information shared should be limited to what is reasonably necessary for that purpose, with appropriate access restrictions and contractual protections where applicable. Consent will be obtained where required. This Policy does not authorize unrestricted sharing among related entities for unrelated marketing.

Independent partners (for example, cooperating brokers; title companies; lenders; inspectors; or contractors) receive information only as described in this Policy (including Section 5.B) and under their own obligations. A referral or introduction does not by itself mean Sundance controls that partner’s privacy practices.

6. SALE OF PERSONAL INFORMATION

Sundance does not sell personal information for monetary consideration as part of its ordinary business operations. Disclosure to service providers or transaction participants for legitimate business purposes is not intended to constitute a sale. If our practices materially change, we may update this Policy and provide opt-out mechanisms where legally required.

7. TARGETED ADVERTISING AND PROFILING

The current Concierge is not used to make decisions producing legal or similarly significant effects about website visitors. If Sundance later conducts qualifying targeted advertising, sale or sharing, or profiling under applicable law, required notices and opt-outs will be provided.

8. COOKIES, LOCAL STORAGE, AND SIMILAR TECHNOLOGIES

We and our service providers may use cookies, session storage, local browser storage, pixels, logs, and similar technologies for sessions, preferences, functionality, cybersecurity, spam prevention, analytics or traffic measurement, diagnostics, and performance. You may control cookies through your browser settings. Disabling certain technologies may reduce website functionality.

9. GOOGLE RECAPTCHA AND SECURITY TECHNOLOGIES

We may use security and anti-spam services such as Google reCAPTCHA, which may process browser, device, and interaction information under their own terms and privacy policies.

10. EMAIL, TELEPHONE, AND TEXT COMMUNICATIONS

If you provide contact information, Sundance may use it to respond to your request. Where legally required, marketing calls, automated calls, prerecorded communications, and marketing texts require legally sufficient consent.

Providing a phone number through a general inquiry does not by itself constitute consent to receive automated marketing calls or texts where separate consent is required. Consent to marketing is not a condition of purchasing brokerage or property-management services unless permitted by law. Where applicable, you may unsubscribe from emails or reply STOP to texts. This Privacy Policy does not itself create TCPA or Florida telemarketing consent.

11. DATA RETENTION

We retain personal information only as long as reasonably necessary for inquiries; client or prospect relationships; real-estate or property-management services; transactions; brokerage records; legal obligations; disputes; security and fraud prevention; and claims. Retention periods may vary by category and purpose. When information is no longer needed, we may delete, anonymize, aggregate, or securely archive it, subject to legal requirements. Backups and disaster-recovery systems may retain copies for additional periods.

12. DATA SECURITY

We maintain administrative, technical, and organizational safeguards designed to protect information. No Internet-connected system or electronic storage method can be guaranteed completely secure. We evaluate security incidents and provide notifications where required by applicable law.

A. Real-Estate Wire and Closing-Fund Fraud Warning

Criminals may impersonate lenders, title companies, attorneys, brokers, or other transaction participants to send fraudulent payment instructions. Messages may appear to come from a familiar person or an existing email conversation.

Before wiring money or following new or changed payment instructions, independently confirm the recipient and payment details with your title company, closing attorney, or other responsible transaction participant using contact information you previously verified. Do not rely solely on email or text, or use a phone number or link supplied in a suspicious message. Treat unexpected changes or pressure to act immediately as warning signs.

If you suspect that you sent money to a fraudulent account, contact your bank immediately and request assistance with recalling the transfer. Notify the responsible transaction participant through independently verified contact information and report the incident to the FBI’s Internet Crime Complaint Center at www.ic3.gov.

These precautions can reduce risk but cannot guarantee that fraud will be prevented.

13. CHILDREN’S PRIVACY

Our website and Concierge are intended for adults seeking real-estate or property information. They are not directed to children under 13. Sundance does not knowingly solicit personal information online from children under 13. If we discover that we have collected prohibited information from a child under 13, we will take reasonable steps to delete it.

14. SENSITIVE PERSONAL INFORMATION

Please do not submit unnecessary sensitive information such as Social Security numbers; driver-license or passport numbers; financial passwords; full banking or payment-card details; medical information; biometric identifiers; or other legally sensitive data through general website forms or the Concierge. Some transactions may legitimately require sensitive data through separate secure systems.

15. THIRD-PARTY WEBSITES, PORTALS, AND SERVICES

Our website may link to or interact with listing systems, payment platforms, property-management portals, social media, or other independent services. Those third parties operate under their own privacy policies and terms.

Future Sundance accounts and portals. Sundance may later offer its own accounts or portals for owners, residents, agents, or other clients. These Sundance-operated features are not currently available; existing links to third-party services remain subject to those providers’ policies and terms.

If Sundance introduces these features, information processed may include account identifiers, authentication information, profile settings, roles and permissions, login history, and records of activity, documents, or communications within the service. The applicable privacy notice will explain the information collected and its purposes when the feature is introduced. Additional notices or terms will be provided where appropriate.

16. STATE PRIVACY RIGHTS

Depending on your residence and whether a particular privacy law applies, you may have rights that can include: confirmation of processing; access; correction; deletion; portability; opt-out of qualifying sale; opt-out of targeted advertising; opt-out of certain profiling; rights related to sensitive data; appeal; and use of an authorized agent. Rights vary by jurisdiction and are subject to exceptions. Sundance may voluntarily respond to privacy requests even when a particular law does not apply, without admitting that the law applies.

17. CALIFORNIA AND OTHER STATE-SPECIFIC DISCLOSURES

Depending on the circumstances, categories of personal information we may collect include: identifiers; customer-record information; Internet or other electronic network activity; approximate geolocation; professional or commercial information; property or transaction information; communications; and inferences based on volunteered information. Sundance does not sell personal information for monetary consideration as part of ordinary operations. Where legally required, we will honor legally recognized universal opt-out mechanisms in accordance with applicable law and technical standards.

18. DO NOT TRACK SIGNALS

Traditional browser Do Not Track signals may not be honored because no universal standard exists. This does not limit any obligation to recognize legally required universal opt-out mechanisms.
